Terms of Service

1. Acceptance of Terms

By accessing or using HK Reach ("the Service"), provided by Harikrishna Enterprise, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Service Description

HK Reach provides access to the WhatsApp Business Cloud API through a web-based platform. The Service enables businesses to send bulk messages, manage templates, run campaigns, and integrate messaging via REST API.

3. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these terms. You must NOT use the Service to:

  • Send unsolicited messages (spam) to recipients who have not opted in.
  • Violate Meta's WhatsApp Business Policy or Community Standards.
  • Send messages containing illegal content, hate speech, adult content, or misinformation.
  • Harass, intimidate, or threaten individuals.
  • Impersonate any person or organization.
  • Attempt to reverse engineer or circumvent security measures of the platform.

Violation of this policy may result in immediate account termination without refund.

4. WhatsApp / Meta Policy Compliance

You are solely responsible for complying with Meta's WhatsApp Business API terms, messaging policies, and template approval guidelines. Harikrishna Enterprise is not responsible for messages rejected by Meta or accounts disabled due to policy violations by the user.

5. Subscription and Payment

  • Subscription fees are charged in advance for the selected plan duration (3, 6, or 12 months).
  • Fees are non-refundable once the subscription period has started, except where required by law.
  • Meta's conversation charges are your direct responsibility and are separate from our platform fees.
  • Harikrishna Enterprise reserves the right to change pricing with 30 days' notice.

6. Data and Privacy

Your use of data within the platform is governed by our Privacy Policy. You retain ownership of all data you upload (contact lists, media files). By using the Service, you grant us permission to process this data to deliver the Service.

7. Intellectual Property

The HK Reach platform, including its design, code, and content, is the intellectual property of Harikrishna Enterprise. You may not copy, distribute, or create derivative works without written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Harikrishna Enterprise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: message delivery failures, WhatsApp account restrictions imposed by Meta, or data loss.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these terms, illegal use, or non-payment. You may stop using the Service at any time.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
